AI & Data Processing Addendum (DPA)

Version 1.0 Effective Date: September 1, 2026

This AI & Data Processing Addendum ("DPA") governs the processing of data, machine learning pipelines, custom bot architectures, cross-cultural software plugins, embodied AI telemetry, and third-party AI/robotics API integrations executed by AM Digital Designs ("Studio", "we", "us") for B2B Client Services, local commercial business integrations, and Innovation Lab operations.

1. Third-Party AI & Robotics Architecture & Zero-Training Guarantee

AM Digital Designs integrates enterprise-grade Large Language Models (LLMs), multimodal spatial vision models, speech-to-speech pipelines, and robotics control APIs (including OpenAI, Anthropic, custom vector databases, and ROS/robotics endpoints). We configure all API pipelines using enterprise endpoints that strictly opt-out of model training. Your proprietary business data, customer interactions, cultural training sets, and robotics telemetry processed through our custom software or plugins are never used to train public AI models.

2. Embodied AI, Humanoid Actuation & Operational Disclaimers

Artificial Intelligence and machine learning models are inherently probabilistic and may produce unexpected outputs or physical motion commands ("actuations"):

Digital Output Validation: The Client is solely responsible for reviewing and validating all text, code, graphics, or automated replies produced by AI systems prior to commercial deployment.
Physical Hardware & Humanoid Actuation: For software, plugins, or AI agents integrated into physical robots, commercial hardware, or spatial interfaces operating within local businesses, the Client is solely responsible for maintaining physical safety perimeters, emergency stop (E-stop) mechanisms, and operational supervision. The Studio disclaims liability for mechanical damage, physical collisions, or operational interruptions resulting from third-party hardware executing AI plugin logic.

3. Cross-Cultural Plugin Telemetry & Spatial Data Routing

When deploying cross-cultural plugins, spatial interfaces, or localized interaction modules across commercial business environments or robotics platforms:

Anonymized Telemetry: Interaction logs, cultural adaptation metrics, and gesture/speech recognition telemetry gathered to refine cross-cultural software responsiveness are stripped of direct Personal Identifiable Information (PII) before transmission.
Biometric Protection: Any spatial mapping, facial gesture analysis, or voice telemetry processed by our plugins is handled in strict compliance with our Privacy Policy and is never sold or repurposed for commercial profiling.

4. Cross-Border Data Transfers & International AI Compliance

AM Digital Designs designs software and robotics plugins for global deployment. Where processing involves the cross-border transfer of data or deployment in international jurisdictions (such as the European Union, Asia-Pacific, or the Americas):

Standard Contractual Clauses (SCCs): International data transfers adhere to recognized data transfer mechanisms, including European Commission Standard Contractual Clauses (SCCs), ensuring equivalent data protection standards globally.
High-Risk AI & Regulatory Governance: For AI modules or humanoid software interacting directly with humans in commercial settings, the Studio implements risk management assessments, transparency logging, and bias mitigation protocols aligned with emerging global standards, including the EU AI Act.

5. Ownership of Input Data, Custom Plugins & AI Deliverables

Clients retain 100% ownership of all proprietary text, documents, brand assets, business databases, and custom cultural datasets ("Input Data") submitted to custom AI workflows. Upon full invoice clearance, all custom prompt templates, fine-tuned weights, bespoke plugin integration code, and master software deliverables transfer to Client ownership.

6. Autonomous Agents & Human-in-the-Loop (HITL) Oversight

For custom autonomous digital agents or physical robotic automation systems capable of taking independent actions (such as sending emails, updating CRMs, modifying databases, or executing physical robotic movements), Clients agree to maintain appropriate human-in-the-loop (HITL) monitoring. AM Digital Designs disclaims liability for unauthorized actions, financial losses, or operational errors resulting from unmonitored automated workflows.

7. Data Security & Encryption Standards

All data transmitted between Client applications, commercial hardware, AM Digital Designs servers, and third-party AI model providers is protected using TLS 1.3 bank-grade encryption in transit and AES-256 encryption at rest. API keys, hardware credentials, and environment secrets are isolated in encrypted key vaults.
